  • To provide accurate data about arrestees.

The Florida Public Records Act governs your right to view and to obtain copies of arrest information generated by government entities in Brevard County. In addition, Florida Statute 943.053 specifically governs public access to criminal history information, which may include arrest records.

Are Arrest Records Public Information in Brevard, Florida?

Under the Florida Public Records Act, most arrest information in Brevard County is public record. As such, almost anyone may view or obtain arrest records from designated public entities. These entities are required by law to release the records upon public requests. 

Note that public entities can legally refuse access to specific arrest information. The exempted arrest data may include information whose disclosure may violate the privacy or safety of concerned parties. Examples of non-public arrest records include the following:

  • Juvenile arrest records
  • Sealed or expunged arrest records
  • Confidential information about informants and complainants.
  • Medical and mental health records compiled as part of crime evidence.
  • Information regarding an active or ongoing criminal investigation
  • Personal information about crime victims and arresting officers.

Brevard County Arrest Search

In Brazos County, record seekers may search arrest records in online databases maintained by state- and federal-level agencies. The Florida Department of Corrections hosts an online searchable inmate database. The database provides information on inmates serving time in state correctional facilities. It may also include arrest information, such as the names of arrestees, arrest charges, and bond amounts. Record seekers may view such information on the platform by providing the inmate’s full name or DC number.

Alternatively, you can look up inmate records via an online searchable portal maintained by the Federal Bureau of Prisons. The database comprises information on inmates currently serving time in federal prisons. Inquirers must enter an inmate's name or prison number to view arrest data in the database.

Inquirers can also search arrest information in criminal history databases. The Florida Department of Law Enforcement (FDLE) hosts online searchable databases for criminal history records. Inquirers using these platforms are required to pay a $25 processing fee before providing the required search data.

Brevard County Inmate Locator

The Brevard County Sheriff’s Office maintains an inmate search database for recently booked persons in the county. Inmate databases typically reveal arrest information, including arrestees' names and personal information, arrest charges, booking dates, and bond amounts. 

Interested persons may view arrest records in the database by using these steps:

  1. Visit the Brevard County Inmate Search platform.
  2. Fill out the required field: the inmate’s first and last name, the booking number, and the subject number.
  3. Click “Search” to generate relevant information.

Note that the inmate search platform may not include confidential arrest information. Record seekers may obtain such data by making an offline request to the county sheriff’s office. The sheriff may require valid IDs and copy fees before releasing the record to eligible parties.

Active Warrant Search in Brevard County

In Brevard County, arrest warrants are court orders that authorize law enforcement officers to arrest suspected offenders. Court judges or magistrates typically issue arrest warrants upon receiving an affidavit or complaint from law enforcement officers. The complaint must reveal sufficient evidence that the offender has committed or intends to commit a crime.

Under Section 901.02 of Florida Laws, an arrest warrant is legal when it includes the following data:

  • The defendant’s name and personal-identifying features like body markings, gender, and ethnicity.
  • Name and signature of the warrant-issuing authority.
  • Criminal charges
  • A statement that the defendant must be apprehended and brought before the court.

Searchers can also view arrest warrant records by conducting searches on an online searchable portal maintained by the clerk’s office.

How to Find Arrest Records for Free in Brevard

Record seekers in Brevard County may search arrest records for free via online databases maintained by state- and county-level agencies. At the county level, the Brevard County Sheriff’s Office hosts a free search platform for recently arrested persons. Inquirers may view records on the platform by filling in the inmate’s full name and booking number.

At the state level, the Florida Department of Corrections offers a free search platform for inmates held in state-owned correctional facilities. Inquirers may view arrest information by inputting the inmate’s name or prison-identifying number. The Florida Department of Law Enforcement (FDLE) also maintains searchable databases of offenders arrested in Brevard County. These databases include the following:

Note: Free online search platforms may exclude older arrests, supporting documents, and redacted arrest information. Inquirers can generally view such records by submitting an offline request to the arresting agency. The agency may charge fees for retrieving and copying arrest records.

Brevard County Arrest Report

Brevard County arrest reports are documents that provide full information about an arrest event. Arresting officers generate arrest reports to provide evidence of probable cause for the arrest. Such documents may include the officer’s account of the incident, statements from witnesses, and evidence collected at the crime scene. Arrest reports are typically under the purview of the arresting agency. So, interested parties may access such documents by requesting the arresting agency.

In contrast, arrest records contain a summary of arrest events and post-arrest information. They are usually created when an arresting agency books an offender. An arrest record may include the arrestee’s personal details, fingerprint, mugshot, arrest date and location, initial charges, and bond information.  With that being said, arrest records are usually accessible via the county sheriff’s office or the clerk of the circuit court.

How to Get an Arrest Record Expunged in Brevard County

You may get an arrest record expunged by filing a petition with the circuit court in Brevard County. To expunge, you may follow these general steps:

  1. Meet the eligibility requirement: Per Art. 45.0216, you are eligible to expunge arrest records under these conditions: 
    • You were not convicted, and there was no court-ordered supervision.
    • You were tried by the court but were acquitted, pardoned, or dismissed.
    • You were convicted but later received a pardon.
  2. Obtain a certificate of eligibility from the Florida Department of Law Enforcement (FDLE). You may obtain the certificate by using these simple steps: 
    1. Fill out and download the certificate application form.
    2. Visit your local law enforcement agency and get fingerprinted on an FBI Application Card (Form 40-024).
    3. Get a certified copy of the disposition of charges from the Clerk of Courts Office at:

How Do You Remove Brevard County Arrest Records From the Internet?

You must first obtain a court order for expungement before you can remove arrest records from the internet. Upon receiving the order, you may forward it to all websites containing your arrest information. These websites typically provide their contact information on their “About Us” or “Contact Us” page. 

Florida Statute 901.43 requires the website to remove your mugshot within 10 days of receiving your photo ID and a copy of the court order. You may also notify the Brevard County Sheriff’s Office about the need to remove your records from their online database.

What Do Public Brevard County Arrest Records Contain?

Public Arrest records in Brevard County may provide information on the following:

  • The arrestee’s name and personal details, like the mugshot, ethnicity, height, and age.
  • Arrest charges
  •  Arrest date and location
  • Name of the arresting agency
  •  Booking date and time.
  • Bond amount.

Record custodians may not disclose sensitive arrest information to the public. Sensitive arrest data may include juvenile arrest records, crime victims’ statements, and sealed arrest files. Such information is accessible only to legally eligible parties, such as the record subject, legal representatives of the concerned parties, and parents and immediate relatives of the concerned parties.
